I was named as a defendant in foreclosure summons/complaint. The loan, taxes and deed is in ex wifes name only and I have moved from property over 3 years ago. In the divorce the judge awarded the property to ex. I did file a declaration of homestead 10 years ago and was told that even though I moved and have filed a declaration of homestead on my new primary residence, I was supposed to file an abandonment of homestead on the old property. I went right to the clerk recorder and filed the abandonment. Do I have to answer the summons if I have no ownership or liability in the property. I did send the filed notice of abandonment to banks attorney and they will not respond.
I would, otherwise, you may get a default anyway.
