How do you respond to foreclosure notice by court/judge?

Dh wants to respond to the court (if there is still enough time) to answer why we are in foreclosure in hopes that it will buy us some more time. We had twenty days to respond, so I know we are coming up on that time frame in the next week. Can we just give an honest response as to why we are in foreclosure - such as the mortgage company told us to not make payments because there would be plenty of time to catch up, and even though they said the foreclosure process would continue, they still told us to wait for a decision on the modification. Instead, we find out to reinstate our loan, not only do we have to pay it up to the current month, but they have tacked on over $3,000 in "foreclosure fees". We will have some money from a student loan to catch up the payments, but not the extra $3,000. Would a judge consider this issue and possibly require them to reinstate our loan? Or, are we just wishfully thinking?? Also, if we don't respond, how much time do we have to find another place??? The mortgage company told me that after a judge signs off, we will have between 2 and 4 weeks to leave before it is sold! I was thinking that this is pretty fast considering we are less than 6 months late, but perhaps it's because we already have a bk7 on the loan....I don't know. It's really hard to find anything to rent in our area during the winter.
